Yellow Freesia Membership Agreement

1. Parties

This Membership Agreement is concluded between Sarı Frezya Uluslararası Çiçekçilik San. ve Tic. Ltd. Şti. and the user who creates a membership through the website, under the terms and conditions set forth below.

2. Definitions

In this agreement;

Site: The website of Sarı Frezya and all related digital platforms,

Company: Sarı Frezya International Floriculture Industry and Trade Ltd. Co.

Member: A natural person who registers on the site, creates an account, and uses the services offered through the site.

It expresses.

3. Subject of the Agreement

This agreement defines the terms and conditions of the membership created by the Member on the Sarı Frezya website, as well as the rights and obligations of the parties.

4. Membership Terms

Users wishing to register on the site are obligated to provide accurate, complete, and up-to-date information requested in the registration form. By completing the registration process, the Member declares that they have read, understood, and accepted this entire agreement.

The company reserves the right to suspend or terminate membership if false, incomplete, misleading, or unlawful information is provided.

5. Member's Rights and Obligations

The member agrees to use the site only for lawful purposes. The member;

• It will infringe upon the rights of third parties,
• It will damage the system.
• They will engage in actions aimed at gaining an unfair advantage,
• This will create misleading or malicious use.

They are obliged to refrain from all kinds of behavior.

Members are responsible for maintaining the security of their username, password, and other login information. Transactions made through the account are presumed to have been made by the Member unless proven otherwise.

6. Rights and Obligations of the Company

The company reserves the right to modify, suspend, or terminate, in whole or in part, the services, content, campaigns, membership system, and terms of use offered on the site at any time.

The company may temporarily interrupt site services due to technical reasons, maintenance work, or in cases of necessity.

7. Accuracy of Membership Information

The member acknowledges that all information provided during registration is accurate, up-to-date, and belongs to them. The member is solely responsible for all consequences arising from incorrect, incomplete, or outdated information.

8. Protection of Personal Data

Personal data belonging to the Member is processed in accordance with the applicable legislation and within the scope of the Personal Data Protection Law (KVKK) Disclosure Statement and Privacy Policy published by Sarı Frezya.

The information shared by the member may be processed for the purposes of carrying out membership procedures, managing order processes, maintaining customer relations, evaluating requests and complaints, fulfilling legal obligations, and sending commercial communications with explicit consent.

9. Commercial Electronic Communication

The member may also consent to receiving commercial electronic messages containing promotional, discount, informational, and marketing content, provided they give their consent. The member has the right to withdraw this consent at any time.

10. Intellectual Property Rights

All rights to all content, visuals, logos, designs, texts, trademarks, software, and similar elements on this site belong to Sarı Frezya Uluslararası Çiçekçilik San. ve Tic. Ltd. Şti. or the respective rights holders.

These materials may not be copied, reproduced, published, distributed, modified, or used for commercial purposes without the prior written permission of the Company.

11. Suspension and Termination of Membership

If the company determines that the Member has acted in breach of this agreement, misused the site, engaged in unlawful activity, or infringed upon the rights of third parties, it may temporarily suspend or permanently terminate the membership.

If a member wishes to request the termination of their membership, they can submit this request to the Company via the email address [email protected] . Records required to be kept under legal retention obligations are reserved.

12. Limitation of Liability

The company cannot be held liable for any damages arising from service interruptions due to internet infrastructure problems, technical malfunctions, maintenance work, issues originating from third-party service providers, or force majeure events.

The company is not responsible for any direct or indirect damages arising from the Member providing incorrect or incomplete information to the site.

13. Contract Amendments

The company reserves the right to make changes to this membership agreement at any time. The updated agreement text will come into effect on the date it is published on the site. The member's continued use of the site means that they accept the updated text.

14. Applicable Law and Jurisdiction

The laws of the Republic of Turkey shall apply to the implementation of this agreement. In the event of any disputes arising between the parties, the consumer arbitration boards and consumer courts, which are competent and authorized in accordance with the applicable legislation, shall have jurisdiction.

15. Entry into force

By registering on the site, the member declares that they have read, understood, and accepted this entire agreement. This agreement enters into force upon the member's electronic confirmation.
